When contacting us, please be prepared to provide the name of the person or entity the document request is under. You should receive a response within 2 business days of your inquiry.
Service of Subpoena
Fidelity & Guaranty Life Insurance Company (鈥渢he Company鈥) honors lawfully issued subpoenas. While the Company will accept emailed or mailed lawfully served subpoenas, serving the Company in this manner may delay our response. If you seek documents and/or information from the Company in connection with a legal matter, please serve your subpoena upon the Company鈥檚 Registered Agent: The Corporation Trust Company (鈥淐T Corporation鈥). Please contact the Insurance Commissioner for service of process for the Company for the following states: Illinois, New Jersey, North Carolina, Pennsylvania or Florida.
Note that the Company is not registered to do business in the state of New York; it is an Iowa corporation. As such the Company is not subject to the subpoena power of the New York State Courts, nor is it subject to personal jurisdiction in New York.
The process for serving out of state subpoenas in Iowa is set forth under Iowa Rule 1.1702.
Requests for policies issued in New York only must be served upon Fidelity & Guaranty Life Insurance Company of New York via the NYDFS Superintendent of Insurance.
Service of subpoenas in any other matter may not be in compliance with the law and will likely result in delay.

Processing Time
Subpoenas must allow reasonable time for compliance and may not impose undue burden or expense. The processing time needed for subpoena fulfillment is approximately 45 business days after a subpoena is properly served. More time may be required if extensive information is requested or if requestors provide insufficient information.
If it has been more than 30 business days since you properly served us and you have not been contacted, you may email subpoenas@fglife.com to provide inquiry about the status of your response.
Subpoena Requirements
Subpoenas should:
- Indicate the court/jurisdiction and include the case number and case style or have an agency letterhead.
- For subpoenas related to policies/policyholders or agents/agencies, they should be issued to the full legal entity name of the Company, which is Fidelity & Guaranty Life Insurance Company or Fidelity & Guaranty Life Insurance Company of New York (please see information under Service of Subpoena).
- Be signed and dated.
- Provide identifying information for the person and/or entity including, but not limited to: Full name, Employer Identification Number (EIN), Taxpayer Identification Number (TIN), social security number and/or date of birth.
- Provide an email address where the link to a folder contained in our cloud-based storage site, Box, may be sent once the responses have been finalized.
Subpoenas should also clearly identify the documents and/or records requested. Any subpoenas received with vague requests may result in limited responses.
